1. Operator and Scope

These Terms of Service ("Terms") govern the use of the platform www.scopedynamic.com and all associated services operated by:

The Platform includes: a marketplace, software and SaaS portal, information services, AI workload services, online gaming, and chat/communication services.

By using the Platform, you agree to these Terms.

2. Account Registration

By registering, you confirm acceptance of these Terms and the Privacy Policy.

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials.

You must be at least 13 years of age. Users aged 13–16 require parental or guardian consent.

You agree to:

• Use the Platform only for lawful purposes
• Provide accurate and non-misleading information
• Not upload or distribute content that violates applicable law
• Not distribute malicious software or harmful content
• Not conduct automated scraping without express permission
• Respect third-party intellectual property rights
• Not impair the Platform's infrastructure

Violations may result in account suspension, content removal, and claims for damages.

5. User-Generated Content (UGC)

By publishing content on the Platform, you grant the operator a non-exclusive, worldwide, royalty-free license to use such content for operating and improving the Platform.

You warrant that you hold all necessary rights to published content. Unlawful content may be removed without prior notice.

6. Payment Terms

• Prices include applicable taxes unless stated otherwise.
• Payment is processed via available payment methods.
• Access to paid services may be suspended in the event of payment default.
• Digital content is excluded from the right of withdrawal once delivered (upon explicit user consent).
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period.

7. Right of Withdrawal (EU Consumers)

EU consumers generally have a 14-day right of withdrawal. For digital content, this right expires early if the user has expressly consented to performance commencing before the withdrawal period ends and has acknowledged the loss of this right.

8. Availability and Warranties

The operator strives for high availability but does not guarantee uninterrupted access. Maintenance, technical issues, or force majeure may cause interruptions. AI services are provided without warranty as to output accuracy.

9. Limitation of Liability

Full liability applies for damages to life, body, or health, and for intentional or grossly negligent breaches.

For slight negligence, liability is limited to foreseeable, contract-typical damages for breaches of cardinal contractual obligations. Other liability for slight negligence is excluded.

The operator is not liable for third-party content. Liability for AI-generated outputs is excluded to the extent permitted by law.

10. Intellectual Property

All content and intellectual property on the Platform is owned by the operator or respective rights holders. Unauthorized reproduction or distribution is prohibited.

11. Termination and Suspension

You may delete your account at any time. The operator may suspend or delete accounts for violations of these Terms or abusive use. Deleted data cannot be restored.

12. Digital Services Act (DSA)

BinaryBudget may be subject to the EU Digital Services Act. Unlawful content may be reported via the reporting function or by emailing info@scopedynamic.com. Reports will be reviewed and acted upon within a reasonable timeframe.

13. Governing Law and Jurisdiction

German law applies, excluding the CISG. For merchants, the place of jurisdiction is the operator's registered place of business.

Should any provision be invalid, the remaining provisions remain unaffected. The operator may amend these Terms with reasonable notice.
